Akunah understands the importance of delivering a strong position for personal data security and we are committed to ensuring a high level of data protection for everyone who is involved with using our products and services. This policy covers all personal information and data required to access and make use of Akunah products and services, and is intended to help in understanding the information we collect, why we collect it, and how you can update, manage, export, and delete your information.
Information Collection
Akunah may request personal information from you so that we can provide adequate services to you, or where this is necessary for our functions or activities. In particular we collect information from medical practitioners and patients.
The personal data we collect will include information relating to contact information, authentication, identification, occupation, and demographics. We may also collect medical data relating to your health, such as:
Assessment and evaluation data, physical characteristics and other information relevant to the proposed treatments and outcomes;
Previous surgery, diagnosis, radiology scans, 3D models, anatomy, anatomical measurements;
Health and medical history, including your symptoms, medications, and any previous diagnosis and treatment given to you.
Information is always collected in a lawful and fair manner, whether directly from the practitioner or patient, or through our products.
Legal Basis:
Akunah will process these data in compliance with one of the legal basis as outlines below:
Your prior consent; which clearly expresses your approval for Akunah to performing data processing activities.
Compliance with a legal obligation; e.g. where we need to disclose or retain personal data for compliance with applicable laws and regulations.
Entering into a contractual relationship between yourself and Akunah.
A legitimate interest of Akunah in relation to applicable data protection laws.
Data Processing:
Your data may be requested and used for the purposes of product access and support, healthcare delivery and management, and feedback and complaints. Personal data may also be processed by Akunah in a de-identified or pseudonymised fashion and aggregated form for record purposes, research, data analysis, software/device development and improvement. In addition, Akunah may use personal data to comply with all applicable laws and regulations. Personal data may also be disclosed to third parties, if required to provide the proposed services or by law.
Data Storage and Protection:
Personal data provided will only be accessible by those authorised by Akunah. Data entered via the Software is securely hosted in the Commonwealth of Australia by an approved hosting provider in order to provide the level of confidentiality and security adapted to the nature of data processed.
We take reasonable steps to protect personal information we hold about you from misuse, interference and loss, and from unauthorised access, modification or disclosure. These measures shall take into account the state of the art, the costs of implementation and the nature, scope, context and purposes of processing as well as the risk of varying likelihood and severity for the rights and freedoms of natural persons. We store your Personal Data on servers that have various types of technical and physical access controls, which may include, for instance, if appropriate, encryption.
Third Party and Cross Boarder Transfer
Where possible we will aggregate, pseudonymise or anonymise Personal Data to minimise how personally identifiable information is communicated to third parties. To the extent that personal data may be accessed by Akunah third party affiliates located outside the Commonwealth of Australia, including in the European Union or the United States, different privacy standards may apply to how your data is used and protected in those countries. Akunah has appropriate safeguards in place in accordance with all applicable legal requirements to ensure that data is kept confidential and protected with an adequate level of data protection with all third parties. We require all those with access to adopt standards that ensure an equivalent level of protection for data as that adopted by Akunah.
Period of Retention
Personal data will be kept by Akunah for a length of time that will vary. The retention period will be determined by the following criteria: (i) the purpose for which Akunah or the practitioner is using personal data (they will need to keep the data only for as long as is necessary for that purpose); and (ii) applicable laws or regulation that may set a minimum period for which Akunah has to keep my personal data.
Your Rights:
You are free to refuse to give consent to provide personal data to Akunah products, services and processing by writing to your practitioner or Akunah directly.
You also have the right to withdraw consent to the processing at any time and by any means, and, where applicable, have the right to: (i) obtain information regarding the processing of personal data and to access such personal data; (ii) request their rectification where they are inaccurate; (iii) request the restriction of the processing of personal data, including objecting to certain processing of personal data and requesting the withdrawal of the consent provided; (iv) to request the erasure of personal data; (v) to define guidelines relating to the processing of data after death; and (vi) obtain a copy of personal data processed in the above-mentioned conditions in a structured, commonly used and machine-readable format. The abovementioned rights are subject to the applicable exemptions and restrictions by law.
In the event that consent is withdrawn, or data processing is restricted, Akunah will not be able to ensure adequate product function and services, and may refuse to provide products and services under these circumstances.
Updates to Policy
This Policy may be amended at any time. If material changes are made in how personal information is collected, used, disclosed or otherwise processed, this policy will be updated and notices will be provided when/where appropriate. Any material changes to this Policy will be effective at the time of our posting of the notice of the update. We recommend that you regularly review the Privacy Policy when using Akunah products and services.
